These terms apply to your use of this website and all of the sites, content, products, and/or services owned or operated by My Internal Weather, LLC, including but not limited to www.myinternalweather.com (collectively, the “Resources”).

 

By accessing, using, or purchasing any of our Resources, you agree to be bound by and to follow these terms.

 

We reserve the right to modify these terms at any time, so please check this page periodically for changes. By using the Resources after we post any changes to these terms, you agree to accept those changes, whether or not you have reviewed them or been notified about them. If at any time you choose not to accept these terms, please do not use any of our Resources.

1.     Online Payments

 

Payment for your online purchases shall be made via credit card, debit card, Paypal, Venmo, or other MIW-approved payment method, as specified at the point of payment. By placing an order with us, you agree that we may charge your account the full purchase price, including all fees for shipping and all applicable taxes, immediately.  All prices and other dollar amounts are listed in U.S. Dollars.

 

By placing an order with us, you represent and warrant that the credit card or payment account being used is yours, and/or that you are duly authorized to use the account, and you agree to indemnify and hold harmless My Internal Weather, LLC, and each of its officers, directors, employees, contractors, coaches, representatives, agents, successors and assigns (each, a “Company Releasee” and collectively, the “Company Releasees”) from any and all damages or losses of any nature or kind, including attorneys’ fees, that any Company Releasee may incur arising from any breach of or inaccuracy in the foregoing representation and warranty.

 

Every effort has been made to ensure the accuracy of prices, items, and availability of Resources available through our sites; however, typographical or clerical errors do occur. Accordingly, we reserve the right to revoke any stated price and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we will issue a credit or charge to your account in the amount of the charge. 

 

Images of Resources on the sites are for illustrative purposes only; actual Resources may differ from such images.

 

We will email you to confirm the placement of your order and with details concerning product or service delivery. In the event that there is an error in this email confirmation or with course emails, it is your responsibility to inform us as soon as possible. 

 

2.     Refunds

 

It is our policy to provide all of our clients with the best learning and coaching experience possible. 

 

To support all coaching clients in realizing their coaching objectives, all purchases of coaching packages are final and non-refundable.

 

Similarly, and because we deliver our course materials digitally upon your payment, all course purchases are final and non-refundable.

 

3.     Liability

 

You agree that under no circumstances shall we be liable for direct, indirect, incidental, consequential, special, punitive, exemplary, or any other damages arising out of your use of the site or Resource. Additionally, MIW is not liable for damages in connection with (i) any failure of performance, error, omission, denial of service, attack, interruption, deletion, defect, delay in operation or transmission, computer virus or line or system failure: (ii) loss of revenue, anticipated profits, business savings, goodwill or data; and (iii) their party theft of, destruction of, unauthorized access to, alteration of, or use of your information or property, regardless of our negligence, gross negligence, failure of an essential purpose and whether such liability arises in negligence, contract, tort, or any other theory of legal liability.

 

The foregoing applies even if MIW has been advised of the possibility of or could have foreseen the damages. In those states that do not allow the exclusion or limitation of liability for the damages, our liability is limited to the fullest possible extent permitted by law. In no event shall MIW’s cumulative liability to you exceed the total purchase price of the Service you have purchased from us, and if no purchase has been made by you, MIW’s cumulative liability to you shall not exceed $100.

 

4.     Intellectual Property

 

All content provided on the site and in the Resources, including all products and all online class and workshop materials are the intellectual property of MIW and are provided to our clients for their learning and not for commercial use. The content of the site and Resources are protected by United States trademark, trade dress and copyright law. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the content of the Site or the Service, in whole or in part without our prior written consent. You may not remove any trademark, copyright, or other notice from the content of the Site or the Service. We reserve the right to immediately remove you from the Service, without refund, and to pursue all available legal and equitable remedies against you if you are caught violating this intellectual property policy. 

 

5.     Disclaimer

 

Every effort has been made to accurately represent MIW's Resources and their potential.  However, MIW cannot guarantee any specific results.

 

You agree that MIW's Resources are not to be used as a substitute for professional advice of any kind, including medical, mental, or legal, and you agree to seek professional guidance for such matters, should they arise, independent of your relationship with MIW.
